A solicitor is recommended to handle the legal paperwork involved (conveyance). It is preferable to use a solicitor who knows the area that you're moving to and specialises in conveyancing.

Your solicitor will overview the contract for sale. Buying a home or property will involve entering into at least one contract (contract for the Sale of Land) and usually a mortgage contract as well. Understanding what your obligation and rights are when entering into contracts such as these is extremely important.

In simple terms, a contract is a promise or set of promises that the law will enforce. “Enforcement” might mean requiring one party to pay the other compensation if they don’t carry out their promises or forcing that party to carry out those promises. For a contract to be in existence the following principles must be set:

  • There must be an offer and acceptance;
  • There must be consideration; and
  • There must be an intention to be legally bound.
